ФІЛОСОФІЯ МІЖНАРОДНОГО КОСМІЧНОГО ПРАВА: ЕТИЧНО-ПРАКСЕОЛОГІЧНИЙ ВИМІР

Анотація

Розглядаються філософсько-практичні проблеми міжнародного космічного права крізь призму ідей комунікативного розуму К.-О.Апеля, Ю.Габермаса, принципу відповідальності Г.Йонаса, теорії справедливості Дж.Ролза. З’ясовані аспекти концептуального фрейму існуючих нормативно-правових документів: пріоритет інтересів людства, відкритість космосу для всіх держав на основі рівності, заборона національного привласнення й окупації космічного простору, верховенство діючого міжнародного права, міжнародна відповідальність, співробітництво, космонавт як уособлення людства тощо. Окреслений абрис соціокультурного підґрунтя міжнародного космічного права у вигляді, з одного боку, протистояння західного та східного геополітичних блоків, а з іншого, їх співпраці у засвоєнні космосу. Висвітлені суттєві ознаки комунікативної теорії К.-О.Апеля й Ю.Габермаса: дискурс, ідеальна та реальна комунікативна спільнота, регулятивні принципи apriori комунікації, планетарна макроетика, комунікативна дія (інтерсуб’єктивність, взаєморозуміння) як важіль врівноваження інструментальної (технічне опанування космосом) й цілераціональної (успіх, конкурентоздатність) дій тощо. Продемонстровані аспекти кореляції між концептом міжнародної відповідальності держав у засвоєнні космосу та принципом відповідальності Г.Йонаса: принципова амбівалентність сучасної техніки, природня та контракторна відповідальність, нові формули категоричного імперативу сучасної епохи, глобальність й трансцендентність сучасної етики. Показані можливості застосування теорії справедливості Дж.Ролза у забезпеченні легітимності принципів пріоритету добробуту інтересів людства, відкритості космічного простору на підставі рівності, співробітництва у горизонтах: чесності на підставі принципів рівності прав та вигідності; розподілу на підставі процедури «завіси невігластва»; взаємної прозорості як основи досягнення спільних домовленостей.
